IMPORTANT BRR CLARIFICATION FROM MAR GENERAL COUNSEL JAYMIE BOWDITCH:

There have been questions concerning the interpretation of the obligation of supervising brokers concerning listings and pending transactions of salespersons.  In the recent information included in reMARks on the Board of Realty Rule revisions, it was not clear that the rule revision which obligates supervising brokers to notify principals that the supervising broker is to assume responsibility of listings and pending transactions applies only upon the termination of a salesperson's association with a supervising broker.  The rule, with the new language underlined, is as follows:

(4)   Upon termination of a salesperson's association with the salesperson's supervising broker, the supervising broker shall immediately notify all principals as to the listings or pending transactions in which the salesperson was involved, that the salesperson is no longer affiliated or associated with the supervising broker and that the listings and pending transactions are the responsibility of the supervising broker.

The rule is very clear that the notification a supervising broker must provide to principals is required only after termination of the salesperson's association with the supervising broker.  Upon any such termination, a supervising broker should send a letter or other written notification to the principals of the salesperson stating that the salesperson is no longer associated or affiliated with that supervising broker and that the listing or pending transactions of each of these principals is now the responsibility of the supervising broker.

Supervising brokers who wish to allow the seller to transfer the listing to the salesperson's new office may wish to consider obtaining a copy of the new listing agreement or other documentation signed by a former salesperson's new supervising broker so that there is something in the file that shows the former supervising broker has been "relieved" of the responsibility for these listings and pending transactions.

As always, if you have further questions you are encouraged to call the Legal Hotline at 406-543-6646.  Jaymie Bowditch
